Accommodation Booking Conditions & General Terms

Vacation Rental Agreement (VRA)

Definitions For the purposes of this VRA, the following definitions shall apply:

  • "Property" refers to the real property, its contents, and related amenities rented to the Guest under this Agreement
  • "Guest" refers to the person(s) occupying the Property, including their family members, invitees, and guests.
  • "Owner" refers to the legal owner of the Property, its agents, and employees.

Deposit A deposit of 50% of the total rental amount is required to book Elite Beach Villas 

Property. This deposit ("Deposit") must be paid within five (5) days of reservation as a partial payment of the rent. If the Deposit is not received within this period, the Owner reserves the right to cancel the reservation without further notice to the Guest.

Security Deposit A refundable security deposit of ($2,500 or $1,500 depending on which villa) is due before the arrival day. The Owner retains the right to withhold the Security Deposit after the expiration or termination of the Guest's tenancy and to deduct from it any costs for extraordinary expenses or damages, including but not limited to:

  • Damage to the Property
  • Loss or misuse of personal property 
  • Excessive laundry or cleaning
  • Staining of linens, towels, carpets, or furniture
  • Loss of keys and/or garage door openers
  • Rearrangement of furniture

If damages exceed the Security Deposit, the Guest shall be required to pay additional fees within ten (10) days of receiving an additional billing statement. Upon departure, after an inspection by the concierge and sign-off by the Guest, funds will be returned.

Payments The balance of all payments must be made at least sixty (60) days prior to check-in. Reservations not paid in full by the due date may be subject to cancellation. Reservations made less than sixty (60) days before check-in require immediate full payment.

Subject to Change If the reserved Property becomes unavailable or uninhabitable, the Owner will offer substitute accommodations or a full refund of all payments received from the Guest, at the Guest's discretion. The Owner is not responsible for acts of Government (e.g., laws and regulations), Acts of God (e.g., hurricanes, natural disasters), or adverse weather conditions. Other than what is described in this paragraph, no refunds will be provided.

Reservation Changes/Cancellation Policy

  • Cancellations made 30 days or more before the check-in date will result in a full refund.
  • Cancellations made within 30 days of check-in will result in forfeiture of all amounts paid unless the Property is rebooked, in which case a 25% rebooking fee will apply.

Disclosure and Indemnity The Guest acknowledges potential risks associated with the Property, including, but not limited to, BBQs, pools, gym equipment, and ocean-related hazards (e.g., high surf, riptides, coral reefs, hurricanes).

By signing this Agreement, the Guest agrees to indemnify and hold the Owner harmless from any liability, damages, or expenses (including legal fees) resulting from injuries, accidents, or death arising from the Guest's use of the Property.

The Guest assumes full responsibility for the Property, including its contents and personal belongings, and agrees to:

  • Adhere to all rules and regulations
  • Prevent unauthorized use of pools and exercise equipment
  • Secure all doors, windows, and vehicles

Theft/Burglary/Break-In Costa Rica is not immune to theft. The Property is equipped with an alarm system. The Guest must take precautions (e.g., locking all doors and windows). In case of theft, the Guest must contact the local police and file a report. The Owner is not responsible for relocation, reimbursement, or loss of personal items.

Smoking Policy The Property is smoke-free. Smoking is permitted only outside the Property, and all smoking materials must be disposed of safely and properly.

Occupancy/Use

  • Only Guests listed in the Annex of the VRA may stay at the Property.
  • The Guest may not sublet or assign the Property.
  • Overcrowding or misrepresentation of the number of Guests will result in immediate eviction.
  • Special events (e.g., weddings, receptions, professional photo shoots) require written consent from the Owner and are subject to additional fees.
  • The Guest must not remove any items belonging to the Owner.
  • The Owner reserves the right to enter the Property for inspections, maintenance, or sales-related purposes (with prior notice).

Check-In/Check-Out Procedures

  • Check-In Time: 3:00 PM
  • Check-Out Time: 10:00 AM

Upon check-out, the Guest must:

  1. Leave the Property neat and tidy.
  2. Store all perishable food in the refrigerator.
  3. Turn off all lights, fans, and air conditioners.
  4. Lock all windows, doors, and louvers.
  5. Return all keys and clickers to their original location.
  6. Leave one (1) set of towels per person and one (1) set of sheets per bed for laundering.

Cleaning The Cleaning Fee is complimentary.

Energy Conservation The Guest must conserve energy by turning off unused electrical appliances. Laundry facilities are available, and one large personal load per day is included. Additional loads will incur a fee.

Animals Animals are not allowed on the Property. Violators will face immediate eviction and an additional cleaning fee of up to $1,000.

Dispute Resolution This Agreement is governed by the laws of Costa Rica. Legal disputes shall be resolved in Costa Rica. If a dispute arises, the Guest shall bear all legal costs, including attorney fees and court expenses.

Invalidity - Severability If any term of this Agreement is deemed invalid or unenforceable, the remainder shall not be affected.

Services/Incidentals Any additional services requested by the Guest must be paid in full via cash or the credit card on file.

Services Cancellation Policy

  • Services canceled less than 72 hours before the scheduled time will be charged in full.
  • Refunds are available only if the Owner receives a refund from the vendor.

Release of Known and Unknown Claims Participation in activities (e.g., hiking, kayaking, surfing, yoga) is voluntary, and the Owner is not liable for any injuries, damages, or losses.

Medical Release The Guest is responsible for any medical expenses incurred during their stay. If emergency medical care is needed, the Guest agrees to reimburse the Owner for any associated costs.

Travel Insurance Guests are advised to secure travel insurance to protect against unforeseen cancellations or loss of personal belongings.

Complete Agreement This Agreement constitutes the entire understanding between the Owner and the Guest. No modifications shall be valid unless in writing. By signing below, the Guest acknowledges full acceptance of these terms.

Agreement The parties agree to the terms of this Vacation Rental Agreement.
